Terms and Conditions of Sale


All orders accepted by funky fresco™ are subject to these terms and conditions of sale.
To be eligible to purchase products on this Website and lawfully enter into and form contracts on this Website under English law you must:
  • Register by providing your real name, phone number, e-mail address, payment details and other requested information.
  • Be over 18 years of age
  • Stipulate a delivery address. Please note that PO box numbers, hotels and accommodation addresses are not acceptable
  • Possess a valid credit or debit card issued by a bank acceptable to us.

Payment

Payment is by paypal or bank transfer with order, or web site order page. We reserve the right to refuse any transactions

Orders

All orders are to be paid in full on order placement. We cannot under any circumstances accept your order without payment first.

Once payment has been received we will confirm that your order has been accepted by sending you an email to the email address provided with your order.

Our acceptance of your order brings into existence a legally binding contract between us.

We do not operate Trade account facilities or payment / cash on delivery terms.

We reserve the right to refuse to accept your order for any reason including, without limitation and whether or not payment has been received by us, if;
  • We have insufficient stock to deliver the goods you have ordered.
  • We do not deliver to your area, or
  • One or more goods you have ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.

If we do refuse your order we will notify you by email and will re credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment.

 

Cancellation

Please note that orders can only be cancelled within a 7- day period of being placed. To cancel your contract you must notify us in writing or email. If you have received the goods before you cancel your contract then you must send the goods back to our contact address at your own cost and risk. Products made as a bespoke or personalised items cannot be canceled after despatch. this includes all murals. Once you have notified us that you are canceling your contract, any sum debited to us from your credit card will be re-credited to your account as soon as possible and in any event within 30 days of your notice of cancellation. If you cancel the contract but do not return the goods to us in the condition they were in when delivered to you or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you. When returning items you are strongly recommended to obtain proof of posting. We cannot accept responsibility for parcels lost in transit. We will only refund or provide an exchange for the costs of postage where the item returned is faulty when supplied.


Delivery

All funky fresco™ products are made to order. funky fresco™ is a UK based on-line company and can deliver in mainland UK. We also deliver outside the UK on the condition that the customer has to pay for all correct delivery charges to the country of shipping and the customer will have to pay any additional tax related and custom charges that may occur. funky fresco is not responsible to pay for any additional charges outside the UK. Delivery prices are detailed on our web site. We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order. Delivery will be made as soon as possible after your order is accepted, usually in 21 working days and in any event within 30 working days of the order. If you require an express service please contact us by phone or email when placing the order and we will do our up most to meet your dead line. The delivery time will be given when your order is confirmed. Please note that an additional delivery charge may be made for this service. You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.


Bespoke Options


All prices quoted exclude delivery, which will be added at our standard rate. Prices quoted dependent on the size and style of the individual artwork. We reserve the right to re- quote for work where retouching, scanning or artwork amendments are required. No work will commence without client approval being given.

Samples

Samples are provided to give you an indication of the product specification and colour. As the samples and full frescoes are printed to order we cannot guarantee that and product specifications and colours are an exact match.

Returns and refunds


We make every effort to ensure that our frescoes are perfect when dispatched, but slight faults or variations in colour may arise during printing or damage caused during delivery. If you package arrives damaged, please ensure you sign for it as such and contact us immediately by phone or email. Examination of the fresco is the buyers’ responsibility. No claims can be accepted after the fresco has been cut or hung. No claim for decorator’s charges will be accepted. It is therefore important that before you start you unwrap your funky fresco and check that all sheets are undamaged. Return any damaged fresco with the labels. Before you start, lay out all the sheets on the floor and check that all pieces are present and you understand the layout. Double check that the dimensions as ordered and that you have all the necessary tools to hand. DO NOT PRE-TRIM the fresco as the wall or ceiling line may be slightly off. Read all the instructions carefully before starting.
In the event of a fault being found, the fresco is damaged or incomplete then we shall have no liability to you unless you notify us by email or in writing at our contact address of the problem within 10 working days of the delivery of the goods in question.

Before returning your fresco please phone or email us to and receive a returns number. You will be responsible for the fresco until it reaches us. For your own protection we suggest you use a secure delivery method that relies on a signature upon delivery. If you do not receive goods ordered by you within 30 days of the date on which you ordered them, then (except where you are dealing as a consumer) we shall have no liability to you unless you notify us by email or in writing at our contact address of the problem within 40 days of the date on which you ordered the goods.
 If you notify a problem to us under this condition then at your option we will either:
  • Make good any shortage or non-delivery,
  • Replace or repair any goods that are damaged or defective, or
  • Refund to you the amount paid by you for the goods in question in whatever way we choose.
And we shall have no further liability to you. Save as precluded by law and except where you are dealing as a consumer, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question. You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. Certain national laws may prohibit the importation or exportation of certain of our goods to you. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under English law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

Notices

Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address at funky fresco™, 4 Lindbergh Avenue, Lancaster, LA1 5FR UK.

Events beyond our control

We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.


Invalidity


If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected to the extent that they are capable of continuing in force without the unenforceable term or condition.
